CARACARA WALLET TERMS AND CONDITIONS
1. THE AGREEMENT
These Terms and Conditions (“Agreement” or “User Agreement”) constitute a contract between you (the “User”) and CaraCara Wallet regarding your use of the CaraCara Wallet Payment Solution (“the Service”).
This Agreement affects your rights, and you should read it carefully. We encourage you to print or save a copy for future reference.
By using the Service, you agree to the terms and conditions contained in this Agreement. If a positive affirmation is required, you will be prompted via a push notification in the app to review and accept updates to the Agreement. The full Agreement will always be accessible within the app.
CaraCara Wallet may update or amend this Agreement in the future, and you will be notified accordingly. Continued use of the Service after any amendments will constitute acceptance of the revised terms. If you do not agree, you have the right to discontinue using the Service.
In this Agreement:
- “You” or “Your” refers to the User.
- “CaraCara Wallet Client” refers to any person or entity using the CaraCara Wallet.
- “CaraCara Wallet,” “CaraCara,” “we,” or “our” collectively refer to CaraCara Wallet and its affiliates, directors, officers, employees, agents, contractors, and partners, including Celbux SA.
2. BECOMING A CARACARA WALLET USER
A CaraCara Wallet User must have a mobile device with internet capability.
User Registration
Registration requires providing a mobile number to CaraCara Wallet. Upon registration, a username and password will be sent via SMS by our partner, Celbux, to activate the account.
3. USER FEES
Users are subject to the following fees:
- Deposit Fee: A 3% charge on deposits made at participating stores with minimum deposit of R20.
- Withdrawal Fee: A flat rate of R10 for cash withdrawals at registered store partners (unless otherwise advised in writing by CaraCara Wallet).
4. REVERSAL AND CHARGEBACKS
- Users may receive a chargeback for a purchase from a registered merchant, provided the merchant initiates the reversal.
- The reversal is subject to the merchant having sufficient funds in their Celbux account.
- Celbux will reverse both the transaction amount and any commission charged, if applicable.
5. CUSTOMER SUPPORT
Users have access to Celbux’s support platform, including:
- Balance and statement inquiries.
- Online query support.
6. ADDITIONAL FEATURES AND BENEFITS
Users receive free instant access to the CaraCara Wallet platform.
7. LIABILITY DISCLAIMER
- CaraCara Wallet is not liable for transactions between Users and Merchants.
- CaraCara Wallet does not guarantee the quality, legality, or suitability of goods and services purchased using the Service.
8. INDEMNITY
Users agree to indemnify CaraCara Wallet against claims arising from:
- Transactions concluded on the CaraCara Wallet platform.
- Payments made to unintended recipients.
- Unauthorized use of passwords.
- Breach of this Agreement.
9. CARACARA WALLET MOBILE APP
The CaraCara Wallet Mobile App operates through network services provided by your carrier. CaraCara Wallet is not responsible for network failures, uncompleted transactions due to network issues, or service unavailability.
10. PRIVACY POLICY
CaraCara Wallet and Celbux comply with all applicable data protection laws, including but not limited to South Africa’s Protection of Personal Information Act (POPIA).
11. CREDIT FACILITIES
The Service does not provide credit facilities. Transactions exceeding available balance will be declined, and fraudulent attempts may be subject to prosecution.
12. CARRIER-RELATED CHARGES
Users are responsible for all carrier charges related to using the Service.
13. ACCURACY OF INFORMATION
Users must provide accurate information. Providing false information may result in account termination and legal consequences.
14. PROHIBITED TRANSACTIONS
Users must not use the Service for:
- Illegal transactions.
- Fraudulent activities.
- Any purpose violating applicable laws.
CaraCara Wallet reserves the right to suspend or terminate accounts involved in prohibited activities.
15. SECURITY & PASSWORDS
- Users are responsible for maintaining password confidentiality.
- CaraCara Wallet is not liable for losses due to password misuse.
16. HACKING & UNAUTHORIZED USE
Attempts to hack, tamper, or manipulate the Service will result in account termination and may lead to legal action.
17. LIMITATION OF LIABILITY
CaraCara Wallet and Celbux are not liable for indirect, special, or consequential damages arising from:
- Use of the Service.
- Acts of third parties (e.g., network providers, software failures, or force majeure events).
18. SECURITY MEASURES
CaraCara Wallet employs encryption and authentication technologies to protect user data. However, absolute security cannot be guaranteed.
19. DISPUTE RESOLUTION & GOVERNING LAW
- This Agreement is governed by the laws of South Africa.
- Disputes will be resolved in South African courts.
20. TRADEMARKS
CaraCara Wallet, Celbux, and associated logos are trademarks and may not be used without permission.
21. ASSIGNMENT
CaraCara Wallet may assign its rights under this Agreement. Users may not transfer their rights without prior consent.
22. MISCELLANEOUS DISCLAIMERS
- Verification of Users is for security purposes but does not guarantee fraud prevention.
- CaraCara Wallet is not responsible for unauthorized interception of data.
- The Services are hosted on Google Cloud and are subject to their infrastructure limitations.
By using the CaraCara Wallet Service, you confirm that you have read, understood, and agreed to the above terms and conditions.
